In a probate action, the court oversees the distribution of your assets to ensure they go to the people you want to have them. Thus, each step must be reviewed or approved by the Probate Court. The Florida Rules of Probate Procedure have an expectation that a probate action should be completed within one year; however, that may be extended according to need.
Probate is typically needed when people haven’t done the necessary estate planning to have their assets transferred to their heirs automatically through trusts and beneficiary designations. Probate might also be needed when people want to have the court oversee the distribution of their property. Most of my clients don’t have go through probate.

Florida Guardianship Attorney
Guardianship proceedings grant someone you the legal authority to handle an incompetent person’s financial and personal affairs. These proceedings are generally needed only when the incapacitated person hasn’t already delegated authority through a Durable Power of Attorney, Designation of health care surrogate prior to incapacity. A Guardianship Proceeding might also be needed if someone is misusing a Durable Power of Attorney and you want to have the court become a referee. If you need to appoint a guardian for a parent or other loved one who has become incapacitated, we can help you through the guardianship process.
